Children with autism struggle to relate directly to other people. But what happens when they interact with a child-sized robot that has an expressive human face but isn't limited by emotional reactions to their struggles?

Researchers at the University of Texas Arlington (UTA) are working with the Dallas Autism Treatment Center to find out through Zeno, a robot that has been tested with patients to help them develop more appropriate responses to everyday social interactions.

"Autism seems to be a good application for these kind of robots, because autistic kids have a hard time relating to adults, but they seem to be very interested in interacting with robots," Dan Popa, a UTA associate professor of electrical engineering and a lead investigator on the research, told us.

Hanson Robotics designed Zeno, whose face moves in a way similar to human faces. Zeno's face is made of an innovative compliant polymer called "flubber" that offers the look and feel of human skin. Popa said motors behind the face push and pull certain points on the material to create up to 10 different facial expressions.

"Zeno has an incredible face," said Carolyn Garver, director of the Dallas Autism Treatment Center, who has worked there with autistic people for 33 years and has used Zeno with her patients. "It feels real."

Garver has collaborated with UTA on feasibility tests with both autistic children and adults to determine if Zeno can be used to help people with autism identify different emotions and feelings. This, in turn, might help them begin identifying those emotions in people -- a fundamental social disability for autistic people.

The robot can interact with patients the way humans do, but it isn't limited by the emotional responses human therapists may have during treatment. There is an element of make-believe about Zeno that ties into the fantasy world "many of these children live in anyway," Garver said. "They don't identify with people very well. The robot is like a bridge. They respond to Zeno. He's nonjudgmental. He doesn't get mad. He can do the same thing over and over again, and he doesn't get tired."

AN ACT relative to a required fluoride statement.

Be it Enacted by the Senate and House of Representatives in General Court convened:

122:1 New Section; Water Systems; Fluoride Statement Required. Amend RSA 485 by inserting after section 14-a the following new section:

485:14-b Fluoride Statement Required.

I. If a public water supply is fluoridated, the following notice shall be posted in the water system’s consumer confidence report: “Your public water supply is fluoridated. According to the Centers for Disease Control and Prevention, if your child under the age of 6 months is exclusively consuming infant formula reconstituted with fluoridated water, there may be an increased chance of dental fluorosis. Consult your child’s health care provider for more information.”

II. The notice shall be located in the section of the consumer confidence report dedicated to water quality.

122:2 Effective Date. This act shall take effect 60 days after its passage.

New Fluoride Warning Coming Soon to Your Water Bills

The largest state legislature in the U.S. recently passed a bill mandating infant fluoride warnings on all water bills in fluoridated communities. On March 15, the New Hampshire House of Representatives voted 253-23 in favor of the bill.

Thanks to a 13-2 recommendation from the House Resources, Recreation, and Development committee, there was no debate over the bill on the House floor. The bill will now go to the Senate. According to the text of the billi , the warning would read:

"Your public water supply is fluoridated. According to the Centers for Disease Control and Prevention, if your child under the age of 6 months is exclusively consuming infant formula reconstituted with fluoridated water, there may be an increased chance of dental fluorosis. Consult your child's health care provider for more information."

Why Infants Should Not Drink Fluoridated Water

Two years ago, a study published in the Journal of the American Dental Association found that fluoride intake during a child's first few years of life is significantly associated with fluorosis, and warned against using fluoridated water in infant formulaii.

Dental fluorosis - a condition in which your tooth enamel becomes progressively discolored and mottled - is one of the first signs of over-exposure to fluoride. Eventually, it can result in badly damaged teeth, and worse... It's important to realize that dental fluorosis is NOT "just cosmetic."

It can also be an indication that the rest of your body, such as your bones and internal organs, including your brain, have been overexposed to fluoride as well. In other words, if fluoride is having a visually detrimental effect on the surface of your teeth, you can be virtually guaranteed that it's also damaging other parts of your body, such as your bones. After all, bone is living tissue that is constantly being replaced through cellular turnover.

Bone building is a finely balanced, complicated process and fluoride has been known to disrupt this process ever since the 1930s.

While generally supportive of water fluoridation, the Centers for Disease Control and Prevention (CDC) does admit that using fluoridated water to mix infant formula may not be in the best interest of your baby's developing teeth. According to their websiteiii:

"Recent evidence suggests that mixing powdered or liquid infant formula concentrate with fluoridated water on a regular basis may increase the chance of a child developing ... enamel fluorosis."

The CDC also states:

"In children younger than 8 years of age, combined fluoride exposure from all sources - water, food, toothpaste, mouth rinse, or other products - contributes to enamel fluorosis."

The lack of formal and easy-to-find warnings about the hazard of using fluoridated water to make infant formula has, and continues to be, a major source of contention. New Hampshire will set a marvelous example for other states if their bill mandating infant fluoride warnings on water bills in fluoridated communities is enacted.

Shifting the Burden of Proof

In writing this article, I was in contact with Jeff Green, National Director of Citizens for Safe Drinking Water, who kindly shared a couple of other success stories with me. A repeated theme in some of the recent cases where communities successfully removed fluoride from their water supply is the shifting of the burden of proof. Rather than citizens taking on the burden of proving that fluoride is harmful and shouldn't be added, a more successful strategy has been to hold those making claims accountable for delivering proof that the specific fluoridation chemical being used fulfills their health and safety claims, and is in compliance with all regulations, laws, and risk assessments already required for safe drinking water.

"It's important to accentuate that these strategic actions focused on the accountability for the actions surrounding the selection and use of the specific substance, rather than just opposition to the public policy where supporters routinely find cover for their actions," Green says.

The word 'Champion' may elicit reverie-like thoughts of a bygone era, but Champions—while rare—can still be found today. A true Champion can be defined as a person in a position of some authority who can reasonably make a probing request, and, most importantly, has the authority to declare that a distorted response—one that does not answer questions directly, or a non-response, simply isn't good enough.

Frank Mora, previous Chairman of a joimt water board in the State of New York, is one example of such a Champion. While neither 'easy' nor 'fast,' Mora's dedication to the ethics of stewardship eventually led to the discontinuation of the addition of fluoride to their water supply in October 2009. The water board, who originally supported the public policy of fluoridation based on endorsements, rejected the use of the hydrofluosilicic acid fluoridation chemical without taking any stance on whether or not it might do harm... Rather the rejection was based on the Board's inability to confirm the compliance of the product with already established laws and regulations for safe drinking water.

Ironically, water fluoridation continued for about a month after the Board made their decision. The reason for this was because the hydrofluosilicic acid they still had on hand would have to have been disposed of as hazardous waste. The cost of proper disposal was considered excessive, so they used up their last reserves before discontinuing it. It's rather amazing to consider that the hazardous waste facility was more committed to identifying the contents and contaminants of the product before they would accept it for treatment than water departments are before adding it to our drinking water!

Endorsements Versus Due Diligence...

A town in Tennessee also found a Champion in its Mayor Robinson, and the town, while keeping its resolution to fluoridate intact, unanimously ended its use of its chosen hydrofluosilicic acid fluoridation substance a couple of years ago, and as of yet have not found a product that is compliant. According to a press release dated June 10, 2011:

"The shift was to a process of sequentially challenging various authorities to dig deeper into the factual basis for endorsements and assurances, and to provide specific documents.

... The Town exchanged letters with the Tennessee Municipal League Risk Management Pool (TML) explaining the Town's inability to extract information on the content and impurities of the product, the refusal of the chemical supplier to provide specific documents required for compliance with law, and evidence that contaminants such as lead and arsenic are admittedly a part of the product. This resulted in TML's lawyerly response that they wouldn't be able to answer with any certainty what liability coverage the Town could count on until TML received a claim.

Not good enough.

"A point that had to be considered," said Robinson, "is that all of these endorsements, and even assurances and guidance from health agencies, doesn't alter the fact that we as the water operator are the only ones that can select and ultimately be responsible for the benefits or harm from consumption of the product. So while it might be nice to take potshots from the sideline, or to repeat the assurances from someone who has no accountability, if we are going to take our role as stewards of the water supply seriously, we don't get to substitute endorsements for due diligence."

What You Might Find if a Champion Performs Due Diligence

Mayor Robinson makes an excellent point, which is that the stewards of the water supply cannot simply substitute endorsements of safety, effectiveness, and regulatory compliance for the public policy, for due diligence on the actual product used. Questions must be asked, and answers must be provided. Ditto for proof in terms of documentation. If it's all on the up-and-up, this should be a fairly straight-forward process. However, those who have taken on the task of performing due diligence on the actual fluoridation chemical have been surprised by the lack of responsiveness and clarity from the very sources of the safety claims. In addition, in the case of the joint water board in New York, they couldn't even get a single straight answer from the chemical manufacturer about their own product.

This isn't surprising when you consider that there's virtually no evidence supporting the safety or effectiveness of the fluoridation chemical used.

"I don't believe we would have known how to navigate through this process without guidance from someone who is fully informed of all of the regulations that should be considered in our decision-making, as even though we are in the business of delivering water, we were not aware of all of the factors, which were not divulged by the sources we usually rely upon," stated Robinson.

First of all, swallowing fluoride provides little or no benefit to your teeth. It works topically, and not particularly effectively at that. According to the findings of a groundbreaking 2010 study published in the journal Langmuiriv, the benefits of even topical application of fluoride are highly questionable. The study discovered that the fluorapatite layer formed on your teeth when you apply fluoride is a mere six nanometers thick. To put that into perspective, you need 10,000 of these layers to get the width of a strand of your hair! Scientists now question whether this ultra-thin layer can actually protect your enamel and provide any discernible benefit, considering the fact that simple chewing will quickly eliminate it.

Secondly, swallowing fluoride exposes every tissue in your body to both a drug and a toxic substance.

There is pharmaceutical-grade fluoride, which is used in certain drugs, and adding it to the public water supply equates to forcing a medication on the entire population, without regard for dose or frequency. However, pharmaceutical grade fluoride is not typically what's added to water supplies... No, the fluoride added to municipal water supplies is the toxic byproduct from the fertilizer industry—a rarely-discussed fact that effectively nullifies most if not all studies pertaining to fluoride—they simply have not studied the correct type of fluoride being added to our water.

Another eye-opening fact is that a pea-sized dollop of fluoridated toothpaste contains about the same amount of fluoride as a large glass of water. The difference is that if you swallow more than a pea-sized amount of toothpaste, you're instructed to immediately contact Poison Control, while there are no warnings issued for fluoridated water, even though there's no way to control the dose any given person will receive on any given day or throughout their lifetime.

Often Overlooked

Advisory from Jeff Green: One element to be addressed is that many of us who are first exposed to issues such as this enter into a world of anger at injustice, where we see the problem so passionately and so clearly that we carry the burden of proof and are in a hurry to tell others to set it right, viewing anyone who does not immediately agree with our view as opposition that must be overwhelmed with facts and a list of "shoulds."

In this state we look angry, and are easily characterized as a zealot, probably because we are. Asking someone without our passion to join us may not be that inviting.

Should we expect that this would be any different when speaking to authorities and asking them to act?

In 1994, a tanker truck carrying fluorisilic acid lost a set of wheels, causing its 4,500-gallon load to spill onto Interstate 4 in Volusia County Florida. Forty-seven people were sent to the hospital as a result, and 2,300 in the area had to be evacuated.

The highway was closed for two days, and those who happened to be nearby had breathing troubles and burning sensations on their skin. Even vehicles that drove through the spill had to be professionally decontaminated, as the chemical was so noxious it could cause respiratory problems to bystanders.i

That chemical -- fluorosilicic acid – is one of the fluoride variants currently added to about two-thirds of U.S. drinking water supplies – what amounts to pure poison in your tap water, under the guise of protecting your teeth.

Water Fluoridation is the Result of a Massively Successful PR Campaign

If you live in the United States, then you undoubtedly have been exposed to mass psychological conditioning. With the average American being accosted with thousands of advertisements each day, whether blatant or not, many pieces of "conventional wisdom" are actually contrived and implanted into society. One method of doing so is through driving public opinion -- the idea that if most people believe it, then it must be true.

The history of this kind of conditioning can be traced back to the early part of the last century, specifically the work of people like Edward L. Bernays, known as the "Father of Spin." Edward L. Bernays took the ideas of his famous uncle Sigmund Freud, and applied them to the emerging science of mass persuasion. However, instead of using the psychological principles to uncover hidden themes in the human unconscious in the way Freudian psychology does, Bernays used them as a marketing tool.

It was this method that led Bernays to become wildly successful in the field of PR and marketing, conditioning Americans to buy into corporate lies.

Bernays dominated the PR industry until the 1940s, and was a significant force for another 40 years after that. During all that time, Bernays took on hundreds of diverse assignments to create a public perception about some idea or product.

One of Bernays' first assignments was to help sell the First World War to the American public with the idea to "Make the World Safe for Democracy." A few years later, Bernays set up a stunt to popularize the notion of women smoking cigarettes …

In the 1930s Edward Bernays was public relations adviser to the Aluminum Company of America (Alcoa) and later was brought on board to promote water fluoridation to the American public – a more than coincidental connection considering it’s been suggested that fluoridating water supplies was a way to protect aluminum and steel producers from lawsuits against the fluorine pollution coming from their plants …

New York City Water Fluoridation Paved the Way for the Entire U.S.

It was, in fact, the Reynolds Aluminum Company that first utilized a pro-fluoride booklet titled “Our Children’s Teeth” (produced by the Committee to Protect Our Children’s Teeth) in court to defend against fluoride injury charges. The booklet included testimonials and statements from scientists that reportedly agreed fluoride posed no harm, but as reported by Associate Professor of Media Studies at Florida Atlantic University James F. Tracy:ii

“ … of the 360 “chemists” and “authorities on nutrition” listed in the brochure, 201 worked for 87 institutions including universities that received over $151 million in grants. In the late 1950s a majority of such grants originated from the foremost proponent of water fluoridation -- the Public Health Service. Another major recipient of PHS funding was the American Dental Association (ADA). Exner's [Dr. F. B. Exner, public health advocate and water fluoridation opponent] research and data proved to be especially valuable in lawsuits brought against the industry and fluoridation proponents. In 1978, shortly after his death, all of his files were lost in an unusual fire.

As the pro-fluoridation propaganda campaign grew to a crescendo in the late 1950s a collaborative surveillance campaign targeting anti-fluoridationists was undertaken by the PHS, the ADA, and the American Water Works Association.

The National Fluoridation Information Service of the Division of Dental Health of the US Public Health Service, an intelligence-gathering setup operating out of the PHS-controlled National Institutes of Health, was formally established to monitor and create databases on fluoridation critics in the medical professions. Fluoride heretics were subject to flailing in the press or outright expulsion from their professional organizations.

Fluoridation was finally launched in New York City in 1965 apart from popular referendum and in the face of continued opposition by handing the choice to the municipality’s five-member Board of Estimate. Behind the final effort to fluoridate were Mary and Albert Lasker. The former was involved in the Committee to Protect Our Children’s Teeth and the latter an advertising executive and associate of Bernays who helped American Tobacco Company make Lucky Strikes America’s best-selling cigarettes.”

Junk Food and Soda Ruins Kids’ Teeth – Not Lack of Fluoride

Following New York City’s decision to fluoridate water, the trend caught on and now upwards of two-thirds of U.S. water supplies contain fluoride. Dr. Karen Sokal-Gutierrez, a pediatrician and former Peace Corps volunteer, pointed out that kids living in El Salvador had near perfect teeth 20 years ago. When she returned to similar villages recently, she noticed the children’s teeth were black, and decay was setting in as young as age 2.

The culprit? Junk food and sodas had replaced many of the staple foods that once made up the children’s diets.

She described one boy who was so emaciated and sick from having all 20 baby teeth decayed that he “looked like a child dying of AIDS.” His parents owned the village store, which meant the boy had “unlimited access to candy.”iii

Dr. Sokal-Gutierrez has been returning to the village and training local health workers about oral health and nutrition. She also trained the dentists to apply fluoride varnish to the children’s teeth.

But the solution here is not fluoride – remember, the children of decades’ past had near-perfect teeth! The solution is to get the junk food and soda out of these kids’ diets. Even in a study that reported low-fluoride toothpaste alone was as effective as toothpaste combined with application of antiseptic chlorhexidine (CHX) gel,iv the researchers noted that the low number of early childhood cavities was most likely the result of “the telephone contact with oral health professionals, increasing the mothers' motivation to follow toothbrushing instructions and dietary advice.”

The Real Risks of Fluoride are Becoming “Mainstream” Knowledge

Earlier this year, the New Hampshire House of Representatives voted 253-23 in favor of mandating infant fluoride warnings on all water bills in fluoridated communities (the bill will now go to the Senate). According to the text of the bill, the warning would read, in part:

"According to the Centers for Disease Control and Prevention, if your child under the age of 6 months is exclusively consuming infant formula reconstituted with fluoridated water, there may be an increased chance of dental fluorosis."

But dental fluorosis is not "just cosmetic." It can also be an indication that other tissues, such as your bones and internal organs, including your brain, have been overexposed to fluoride as well. There are more than 100 published studies illustrating fluoride's harm to the brain,v plus 25 published studies directly linking fluoride exposure to reduced IQ in children!

Fluoride is a toxic agent that is biologically active in the human body where it accumulates in sensitive tissues over time, wreaks havoc with enzymes and produces a number of serious adverse health effects—including neurological and endocrine dysfunctions.

Adding insult to injury, even promoters of fluoridation now admit that fluoride's predominant action is on the surface of the tooth (although even this is now questionable) and not from inside the body – so why are so many Americans still being forced to swallow it? Swallowing fluoride provides little or no benefit to your teeth!

Fluoride compounds like fluorosilicic acid are toxic industrial waste products, which can also be contaminated with lead, arsenic, radionucleotides, aluminum and other industrial contaminants. The story gets even more convoluted, as mentioned earlier, as now declassified files of the Manhattan Project and the Atomic Energy Commission show that the original motivation for promoting fluoride and water fluoridation in the United States was to protect the bomb-, aluminum-, and other fluoride-polluting industries from liability. In the early days some of the sodium fluoride used to fluoridate water supplies in the U.S. came from Alcoa.

A couple of years later, they switched to the even more hazardous waste product hydrofluorosilicic acid from the phosphate fertilizer industry. But none of the studies on fluoride actually used the far more toxic and contaminated hydrofluorosilicic acid that is presently added to the water supply. Rather, they use pharmaceutical-grade fluoride, which while harmful, is not quite as bad as what's being used for water fluoridation. So, the health hazards are likely FAR worse than any study has so far discerned.

Do You Want Healthy Teeth? Eat a Healthy Diet!

When it comes to oral hygiene and preventing cavities, there's a virtual war going on. If you listen to conventional health agencies' and your dentist's advice, you may still believe that fluoride is the answer.

Think again!

Good oral health and strong, healthy teeth are NOT the result of drinking fluoridated water and brushing your teeth with fluoridated toothpaste. Rather it's virtually all about your diet.

Dr. Weston A. Price, who was one of the major nutritional pioneers of all time, completed some of the most extensive research on this topic back in the 1900s, and it is still very much relevant today. What he found, and documented in his classic book Nutrition and Physical Degeneration, is that native tribes who were eating their traditional diet had nearly perfect teeth, and were almost 100 percent free of tooth decay -- and they did not have toothbrushes, floss, toothpaste, or root canals and fillings.

But when these tribal populations were introduced to sugar and white flour, guess what happened … their health, and their perfect teeth, rapidly deteriorated, just like the kids in El Salvador. By avoiding sugars and processed foods, you prevent the proliferation of the bacteria that cause decay in the first place.

Most people whose diet includes very little sugar and few processed foods have very low rates of tooth decay. So the simple act of limiting, or eliminating sugar, and avoiding processed foods -- along with regular cleanings with your natural mercury-free dentist -- will ensure that your teeth and gums stay healthy and cavity-free naturally.

A recently published Harvard University meta-analysis funded by the National Institutes of Health (NIH) has concluded that children who live in areas with highly fluoridated water have "significantly lower" IQ scores than those who live in low fluoride areas.

In a 32-page report that can be downloaded free of charge from Environmental Health Perspectives1, the researchers said:

"A recent report from the U.S. National Research Council (NRC 20062) concluded that adverse effects of high fluoride concentrations in drinking water may be of concern and that additional research is warranted. Fluoride may cause neurotoxicity in laboratory animals, including effects on learning and memory…

To summarize the available literature, we performed a systematic review and meta-analysis of published studies on increased fluoride exposure in drinking water and neurodevelopmental delays. We specifically targeted studies carried out in rural China that have not been widely disseminated, thus complementing the studies that have been included in previous reviews and risk assessment reports...

Findings from our meta-analyses of 27 studies published over 22 years suggest an inverse association between high fluoride exposure and children's intelligence... The results suggest that fluoride may be a developmental neurotoxicant that affects brain development at exposures much below those that can cause toxicity in adults...

Serum-fluoride concentrations associated with high intakes from drinking-water may exceed 1 mg/L, or 50 Smol/L, thus more than 1000-times the levels of

some other neurotoxicants that cause neurodevelopmental damage. Supporting the plausibility of our findings, rats exposed to 1 ppm (50 Smol/L) of water-fluoride for one year showed morphological alterations in the brain and increased levels of aluminum in brain tissue compared with controls...

In conclusion, our results support the possibility of adverse effects of fluoride exposures on children's neurodevelopment.

Future research should formally evaluate dose-response relations based on individual-level measures of exposure over time, including more precise prenatal exposure assessment and more extensive standardized measures of neurobehavioral performance, in addition to improving assessment and control of potential confounders."

Studies have Repeatedly Linked Fluoride to Reduced IQ and Brain Damage

There are so many scientific studies showing the direct, toxic effects of fluoride on your body, it's truly remarkable that it's NOT considered a scientific consensus by now. Despite the evidence against it, fluoride is still added to 70 percent of U.S. public drinking water supplies.

It amazes me that the medical (and dental) communities are so stubbornly resistant to connect the dots when it comes to the skyrocketing increase of cognitive decline in adults, and behavioral issues in children (ADD, ADHD, depression and learning disabilities of all kinds). In fact, there have been over 23 human studies and 100 animal studies linking fluoride to brain damage3. Fluoride can also increase manganese absorption, compounding problems since manganese in drinking water has also been linked to lower IQ in children.

Harmful Effects have Been Known for Half a Century...

What is perhaps most surprising is that the harmful effects of fluoride have been known by conventional medical organizations for over half a century. For example, the Journal of the American Medical Association (JAMA) stated in their September 18, 1943 issue that fluorides are general protoplasmic poisons that change the permeability of the cell membrane by certain enzymes. And, an editorial published in the Journal of the American Dental Association, October 1, 1944, stated:

"Drinking water containing as little as 1.2 ppm fluoride will cause developmental disturbances. We cannot run the risk of producing such serious systemic disturbances. The potentialities for harm outweigh those for good."

Part of the problem is that it's an accumulative toxin that, over time, can lead to significant health problems that are not immediately linked to fluoride over-exposure. In a 2005 paper entitled "Fluoride—A Modern Toxic Waste," Lita Lee, Ph.D. writes4:

"Yiamouyiannis' book, "Fluoride, The Aging Factor," documents the cumulative effect of tissue damage by fluoride, commonly seen as aging (collagen damage), skin rashes and acne, gastrointestinal disorders, and many other conditions, including osteoporosis. The U.S. Center for Disease Control and the Safe Water Foundation reported that 30,000 to 50,000 excess deaths occur in the United States each year in areas in which the water contains only one ppm fluoride.

... Fluoride suppresses the immune system: Fluoride inhibits the movement of white blood cells by 70%, thereby decreasing their ability to reach their target. Yiamouyiannis cites 15 references in his pamphlet, Lifesavers Guide to Fluoridation, that document immunosuppressive effects of as little as 10% of the amount of fluoride used in fluoridated water... Immunosuppressive effects run the gamut, from a cold that won't go away to increased risk of cancer and other infectious diseases."

Long-lost research linking fluoride to cancer has resurfaced in a Dutch film clip featuring Dr. Dean Burk, who in 1937 co-founded the US National Cancer Institute (NCI) and headed its cytochemistry department for over 30 years. In the taped interview, he equates water fluoridation to "public murder," referring to a study that had been done on the 10 largest U.S. cities with fluoridation compared to the 10 largest without it.

The study clearly demonstrated that deaths from cancer abruptly rose in as little as a year or two after fluoridation began. This and other studies linking fluoride to cancer were government-ordered but were quickly buried once fluoride was found to be linked to dramatic increases in cancer.

There's no doubt about it: Fluoride should not be ingested. At least when it comes to topical application, you have a choice. You can easily buy fluoride-free toothpaste and mouthwash. But you're stuck with whatever your community puts in the water, and it's very difficult to filter out of your water once it's added. Many do not have the resources or the knowledge to do so.

The only real solution is to stop the archaic practice of water fluoridation in the first place. Fortunately, the Fluoride Action Network5 has a game plan to END water fluoridation in both Canada and the United States.

Court Prompts Twitter to Give Data to Police in Threat Case

Twitter officials have complied with a court order to turn over account information to help New York police investigators identify who threatened to carry out an attack like the Colorado movie theater shooting at a Broadway theater where Mike Tyson is appearing in a one-man show, the police said Tuesday.

The compliance came three days after the social media company, based in California, denied an emergency request from the Police Department to provide the account holder’s registration information and computer network address. Investigators learned of the unsettling Twitter posts on Friday, the opening night of “Mike Tyson: Undisputed Truth” at the Longacre Theater in Midtown, said Paul J. Browne, a police spokesman.

Mr. Browne declined to say whether investigators had tracked down the person believed to have posted, “I’m serious, people are gonna die like Aurora,” an apparent reference to the deadly shooting last month during a midnight screening of “The Dark Knight Rises” at an Aurora, Colo., movie theater.

The posting was among a string of Twitter posts that alarmed police investigators: “I might just shoot up this theater in New York”; “I know they leave their exit doors unlocked”; “I got 600 people on my hit list and that’s gonna be a mass murder for real.”

Investigators sent Twitter an emergency request for the account information just before midnight on Friday. The company responded at 2:15 a.m. on Saturday, rejecting the request, Mr. Browne said. The New York Post published an article about the subpoena on Tuesday.

“We appreciate the timeliness and sensitivity of this matter, and have reviewed the reported Twitter account,” the company wrote in an e-mail to the police. “While we do invoke emergency-disclosure procedures when it appears that a threat is present, specific and immediate, this does not appear to fall under those strict parameters as per our policies.”

Police investigators disagreed and asked the Manhattan district attorney’s office to obtain a subpoena, which was served on Twitter late Monday, Mr. Browne said.

“We felt that a threat involving an identified location in the heart of the theater district merited immediate cooperation,” Mr. Browne said.

Larry Cunningham, an associate professor and associate dean at St. John’s University School of Law in Queens, said he agreed that Twitter should have cooperated without a court order.

“Social media is of increasing importance to law enforcement and criminal prosecutions,” said Mr. Cunningham, a former criminal prosecutor. “In general, social media outlets do a very good job of cooperating with authorities, but in this case, however, Twitter should have given the information without a court order under their emergency procedures policy. The threats were clear enough.”

A Twitter spokeswoman declined to comment on Tuesday.

Mr. Browne said the Police Department had added officers to patrol the area near the Longacre Theater, at 220 West 48th Street. “We will provide coverage at the Longacre Theater until such time as we identify and locate the person responsible for the threats,” he said Tuesday night.

The Shubert Organization, which owns Longacre, said in a statement on Tuesday: “We are aware of the Twitter threat and have communicated with the appropriate law enforcement agencies. We are taking all appropriate actions under the circumstances.”

“Mike Tyson: Undisputed Truth,” directed by Spike Lee, chronicles the heavyweight boxing champion’s life. Mr. Tyson did not respond to a request for comment sent to his Web site.

The subpoena issued to Twitter was not the first time the Police Department and prosecutors sought court intervention to obtain information.

In May, prosecutors obtained a subpoena requiring Twitter to turn over information about an account holder who had posted on Twitter during an Occupy Wall Street demonstration. In that case, the Manhattan district attorney’s office sought to get previously deleted messages that had been posted by one of the hundreds of demonstrators arrested on the Brooklyn Bridge during a march on Oct. 1, 2011.

Prosecutors argued that the posts might reveal whether the protester was aware that the police had ordered demonstrators not to cross the bridge. Twitter challenged the subpoena, citing privacy laws, but a Manhattan judge rejected the challenge on the basis that the posts are public.

Twitter has given cops details of a tweeter who threatened to go on a shooting rampage at a performance of ex-boxer Mike Tyson's one-man show.

A US court compelled the social network to hand over records it holds on the user a full three days after an initial request from New York police was ignored by the website's team.

The dossier of information was sought after a person using the Twitter account threatened to carry out a mass-killing similar to the shooting attack at a screening of Batman - The Dark Knight Rises in Aurora, Colorado on 20 July. A 24-year-old man, James Holmes, stands accused of killing 12 people and injuring 58 in the movie theatre attack.

Tyson – a regular Twitter user – is appearing in a play about his life, directed by Spike Lee, on Broadway. The show made its New York debut last Friday.

The NYPD took action after being notified of the disturbing threat directed at the heavyweight boxing champ – and presumably the audience attending the show – via the micro-blogging site. The New York cops demanded that Twitter comply with the order to help reveal the identity of the troll, the reported. Twitter typically records when and from which IP addresses its users login from.

But the emergency request sent to California-based Twitter from the police force was initially rebuffed.

Tweets from the troll on Twitter reportedly included comments such as “I’m serious, people are gonna die like Aurora”; “I might just shoot up this theater in New York”; “I know they leave their exit doors unlocked”; and “I got 600 people on my hit list and that’s gonna be a mass murder for real”.

But in the early hours of Saturday morning, Twitter dismissed the request and told the NYC cops in an email message cited by the NYT:

We appreciate the timeliness and sensitivity of this matter, and have reviewed the reported Twitter account.

While we do invoke emergency-disclosure procedures when it appears that a threat is present, specific and immediate, this does not appear to fall under those strict parameters as per our policies.

By late Monday, a subpoena had been slapped on Twitter by a Manhattan District Attorney judge, after the police argued that "immediate cooperation" was necessary.

Twitter declined to comment on this story.

Here in the UK, a teenager was arrested on suspicion of malicious communications after Brit Olympic diver Tom Daley was swamped by abusive tweets late last month. The menacing messages included a threat to drown the swimmer. ®

Debates in Parliament, home visits from the police and distressed celebrities have all left tweeters a little unsure as to what is and what is not acceptable by law on Twitter.

The list of those offending and those offended keeps growing with recent high profile reports referring to Louise Mensch, Tom Daley, Guy Adams, Steve Dorkland, Helen Skelton and Kevin Pietersen. This guide discusses 10 legal risks which apply, or potentially apply, to Twitter, in the context of recent media attention given to the lawfulness of tweets.

Defamation law protects a person's reputation. In England, the law of libel makes it an offence to communicate defamatory remarks where that communication takes some form of permanence (and in Scotland the general law of defamation has the same effect). At least one UK court has given the impression that communications via Twitter have a form of permanence. Defences for truth, honest opinion and providing a public service may apply. However, a claim in libel could result in civil proceedings and claims for damages and costs.

The test: If a tweet lowers a person's standing 'in the estimation of right-thinking members of society' it will breach the law of libel. This may occur where a tweet causes a person to be exposed to 'hatred, ridicule, or contempt', encourages exclusion of that person from society or imputes a lack of professional skill or efficiency.

Number nine: harassing tweets

UK law protects against harassment by means of the Protection from Harassment Act 1997. The legislation provides that "if a reasonable person in possession of the same information would think the course of conduct amounted to or involved harassment" it is harassment. The UK courts have ruled that this could include the publication of words that cause 'alarm' or 'distress'. Two or more tweets would be necessary for a claim of harassment to be made, as it involves a 'course of conduct'. Harassing tweets could result in a claim for damages for anxiety or financial loss, fines or imprisonment for up to six months.

The test: Tweets which the 'reasonable person' would conclude cause alarm or distress may amount to harassment.

Number eight: malicious tweets

Tweets made within the intention of damaging another's business, goods or services through false statements, or which are reckless with the truth as to another's business, goods or services will offend the law against malicious falsehood. A maliciously false tweet could result in a claim for damages for loss and for further compensation for causing distress and 'hurt feelings.'

The test: False tweets with the intent to injure another's commercial interests, or recklessness as to the truth, will amount to malicious falsehood.

Number seven: menacing tweets

A tweet that is grossly offensive, or of an indecent, obscene or menacing character, will offend the Communications Act 2003. The Crown Court considered Paul Chambers' tweet "... I am blowing the airport sky high" to be menacing, however the High Court overturned its decision. The High Court ruled that the Communications Act would not prevent satirical, iconoclastic, or rude comment, expression of the unpopular, unfashionable opinion about serious or trivial matters, humour, comments that are distasteful or even painful to those subjected to them, silly jokes or jokes in bad taste that a person would be likely to brush aside or empty bombastic or ridiculous banter. A tweet that is indecent, obscene or menacing in character could result in a fine or a prison sentence of up to six months.

The test: If a tweet could create fear or apprehension in the minds of anyone who may reasonably be expected to see it the tweet could be considered a menace and an offence under the Communications Act.

Number six: deceptive tweets (and other misrepresentations)

A tweet containing a false statement that induces another person to act on it may offend laws against deceit and the making of misrepresentations. A duty may also arise for a professional or other skilled person not to make careless tweets. Misleading commercial communications may offend either the Consumer Protection from Unfair Trading Regulations 2008, the Business Protection from Misleading Marketing Regulations 2008 and industry based advertising rules. Untrue tweets in a commercial context can result in damages claims and prison sentences of up to two years.

The test: Is the tweet deceptive in nature or likely to deceive?

Number five: impersonating tweets

The Fraud Act 2006 protects against fraudulent activities. An impersonator who opens a Twitter account could be exposed to a claim for fraud if the person who has been impersonated suffers loss or damage as a result of the impersonation. A claim for fraud can result in criminal charges with a penalty of up to 10 years imprisonment and fines.

The test: Misleading or an untrue representation as to a person's identity on twitter could amount to fraud.

Number four: threatening tweets

A tweet could amount to an assault if the person to whom it was directed has a genuine belief that physical harm is imminent. A series of tweets which cause psychological damage to another person may also offend UK criminal law. Criminal sanctions would apply in these cases. A tweet could also amount to intimidation if the tweeter makes a threat to engage in unlawful conduct (for example, violence, destroying property or in some circumstances breaching contractual obligations), which coerces another person into doing something for which they suffer loss or damage. The tweet must however be more than "idle abuse" to offend the law of intimidation. An intimidating tweet could result in a claim for compensation for loss or damages suffered.

The test: Generally, an intention to cause harm or intimidation may offend either criminal or civil wrong laws.

Number three: tweets revealing personal or confidential information

Data protection laws protect against processing of personal information without permission. The rules do not apply to purely personal and household activities. It is unclear whether statements made on twitter could ever be said to be 'purely personal or of a household nature.' Where they are not, there is a risk that data protection laws may be breached if consent is not obtained before revealing another person's personal information. The penalty for breaching data protection laws vary across Europe. In the UK, a breach of data protection laws may result in fines and criminal convictions.

Particularly in the employer-employee context, a person may be bound to keep information of another confidential. A tweet breaching any such obligation could result in a claim for damages or an account of profits for any income made as resulting from the exposed information.

The test: Tweets revealing personal details about another person without their consent may breach data protection laws.

Number two: copied tweets

A tweet could offend copyright law if it reproduces even part of an isolated sentence from a copyright work. Copyright law has changed dramatically over the last few years. Generally, UK laws tended to look at whether a substantial part of a copyright work had been reproduced, publicly made available, distributed, translated or adapted without a copyright holders consent. Substantiality was measured both qualitatively and quantitatively. UK laws also concentrated on whether skill, judgement and labour went into the preparation of a work before concluding that copyright subsists in it. However the effect of a recent European Court of Justice (ECJ) decision, which UK law must conform to, may mean that isolated sentences must be looked at disjunctively from a whole copyright work in order to determine whether an infringement has occurred. Further ECJ decisions have suggested that rather than look for skill, judgement or labour in putting words together, there must be an assessment of whether or not an author has exercised creative choices in the form of intellectual effort in arranging words, images or sounds. Claims for damages for loss suffered and criminal charges with prison sentences of up to two years can result from a tweet that infringes copyright law.

The test: A tweet which reproduces the work of another without consent will offend copyright law if that work gives evidence of another's creative choices in arranging words, images or sounds.

Number one: branded tweets and hashtags

Hashtags, marked with the '#' symbol, are used in order to alert users to relevant conversations taking place on Twitter. There is a risk, however, that combining a hashtag with the trade mark of another person could result in trade mark infringement. Trade mark law generally protects the trade mark owner against use of its trade mark without permission in a way that may create a likelihood of confusion or association with other similar products or services. Where a trade mark has a significant established reputation, the protection will extend to association with any products or services (not merely similar ones) in a manner that amounts to taking an unfair advantage or is detrimental to the distinctive character or repute of the established mark. Use of hashtags in these circumstances potentially could result in a damages claim.

The test: Does the use of a hashtag create a likelihood of association or confusion with the products or services of a trade mark owner?

Conclusion

Twitter raises important issues about privacy, free speech, censorship and individual rights and responsibilities. Of course, there is nothing stopping a person from self-incriminating themselves by tweets revealing illegal conduct such as the reports of a doctor on sick leave. The balance struck by UK law will differ from that struck in other places. Twitter users in both commercial and non-commercial contexts should understand this balance.

Color is an essential part of how we experience the world, both biologically and culturally. One of the earliest formal explorations of color theory came from an unlikely source — the German poet, artist, and politician Johann Wolfgang von Goethe, who in 1810 published Theory of Colours (public library; public domain), his treatise on the nature, function, and psychology of colors. Though the work was dismissed by a large portion of the scientific community, it remained of intense interest to a cohort of prominent philosophers and physicists, including Arthur Schopenhauer, Kurt Gödel, and Ludwig Wittgenstein.

One of Goethe’s most radical points was a refutation of Newton’s ideas about the color spectrum, suggesting instead that darkness is an active ingredient rather than the mere passive absence of light.

…light and darkness, brightness and obscurity, or if a more general expression is preferred, light and its absence, are necessary to the production of colour… Colour itself is a degree of darkness.

But perhaps his most fascinating theories explore the psychological impact of different colors on mood and emotion — ideas derived by the poet’s intuition, which are part entertaining accounts bordering on superstition, part prescient insights corroborated by hard science some two centuries later, and part purely delightful manifestations of the beauty of language.

This is the colour nearest the light. It appears on the slightest mitigation of light, whether by semi-transparent mediums or faint reflection from white surfaces. In prismatic experiments it extends itself alone and widely in the light space, and while the two poles remain separated from each other, before it mixes with blue to produce green it is to be seen in its utmost purity and beauty. How the chemical yellow develops itself in and upon the white, has been circumstantially described in its proper place.

In its highest purity it always carries with it the nature of brightness, and has a serene, gay, softly exciting character.

State is agreeable and gladdening, and in its utmost power is serene and noble, it is, on the other hand, extremely liable to contamination, and produces a very disagreeable effect if it is sullied, or in some degree tends to the minus side. Thus, the colour of sulphur, which inclines to green, has a something unpleasant in it.

When a yellow colour is communicated to dull and coarse surfaces, such as common cloth, felt, or the like, on which it does not appear with full energy, the disagreeable effect alluded to is apparent. By a slight and scarcely perceptible change, the beautiful impression of fire and gold is transformed into one not undeserving the epithet foul; and the colour of honour and joy reversed to that of ignominy and aversion. To this impression the yellow hats of bankrupts and the yellow circles on the mantles of Jews, may have owed their origin.

RED-YELLOW

As no colour can be considered as stationary, so we can very easily augment yellow into reddish by condensing or darkening it. The colour increases in energy, and appears in red-yellow more powerful and splendid.

All that we have said of yellow is applicable here, in a higher degree. The red-yellow gives an impression of warmth and gladness, since it represents the hue of the intenser glow of fire.

YELLOW-RED

As pure yellow passes very easily to red-yellow, so the deepening of this last to yellow-red is not to be arrested. The agreeable, cheerful sensation which red-yellow excites increases to an intolerably powerful impression in bright yellow-red.

The active side is here in its highest energy, and it is not to be wondered at that impetuous, robust, uneducated men, should be especially pleased with this colour. Among savage nations the inclination for it has been universally remarkedy and when children, left to themselves, begin to use tints, they never spare vermilion and minium.

In looking steadfastly at a perfectly yellow-red surface, the colour seems actually to penetrate the organ. It produces an extreme excitement, and still acts thus when somewhat darkened. A yellow-red cloth disturbs and enrages animals. I have known men of education to whom its effect was intolerable if they chanced to see a person dressed in a scarlet cloak on a grey, cloudy day.

The colours on the minus side are blue, red-blue, and blue-red. They produce a restless, susceptible, anxious impression.

BLUE

As yellow is always accompanied with light, so it may be said that blue still brings a principle of darkness with it.

This colour has a peculiar and almost indescribable effect on the eye. As a hue it is powerful — but it is on the negative side, and in its highest purity is, as it were, a stimulating negation. Its appearance, then, is a kind of contradiction between excitement and repose.

As the upper sky and distant mountains appear blue, so a blue surface seems to retire from us.

But as we readily follow an agreeable object that flies from us, so we love to contemplate blue — not because it advances to us, but because it draws us after it.

Blue gives us an impression of cold, and thus, again, reminds us of shade. We have before spoken of its affinity with black.

Rooms which are hung with pure blue, appear in some degree larger, but at the same time empty and cold.

The appearance of objects seen through a blue glass is gloomy and melancholy.

When blue partakes in some degree of the pltis side, the effect is not disagreeable. Sea-green is rather a pleasing colour.

RED-BLUE

We found yellow very soon tending to the intense state, and we observe the same progression in blue.

Blue deepens very mildly into red, and thus acquires a somewhat active character, although it is on the passive side. Its exciting power is, however, of a different kind from that of the red-yellow. It may be said to disturb, rather than enliven.

As augmentation itself is not to be arrested, so we feel an inclination to follow the progress of the colour, not, however, as in the case of the red-yellow, to see it still increase in the active sense, but to find a point to rest in.

In a very attenuated state, this colour is known to us under the name of lilac; but even in this degree it has a something lively without gladness.

BLUE-RED

This unquiet feeling increases as the hue progresses, and it may be safely assumed, that a carpet of a perfectly pure deep blue-red would be intolerable. On this account, when it is used for dress, ribbons, or other ornaments, it is employed in a very attenuated and light state, and thus displays its character as above defined, in a peculiarly attractive manner.

As the higher dignitaries of the church have appropriated this unquiet colour to themselves, we may venture to say that it unceasingly aspires to the cardinal’s red through the restless degrees of a still impatient progression.

RED

Whoever is acquainted with the prismatic origin of red will not think it paradoxical if we assert that this colour partly actu, partly potentia, includes all the other colours.

We have remarked a constant progress or augmentation in yellow and blue, and seen what impressions were produced by the various states; hence it may naturally be inferred that now, in the junction of the deepened extremes a feeling of satisfaction must succeed ; and thus, in physical phenomena, this highest of all appearances of colour arises from the junction of two contrasted extremes which have gradually prepared themselves for a union.

As a pigment, on the other hand, it presents itself to us already formed, and is most perfect as a hue in cochineal ; a substance which, however, by chemical action may be made to tend to the plus or the minus side, and may be considered to have attained the central point in the best carmine.

The effect of this colour is as peculiar as its nature. It conveys an impression of gravity and dignity, and at the same time of grace and attractiveness. The first in its dark deep state, the latter in its light attenuated tint; and thus the dignity of age and the amiableness of youth may adorn itself with degrees of the same hue.

History relates many instances of the jealousy of sovereigns with regard to the quality of red. Surrounding accompaniments of this colour have always a grave and magnificent effect. The red glass exhibits a bright landscape in so dreadful a hue as to inspire sentiments of awe.

GREEN

If yellow and blue, which we consider as the most fundamental and simple colours, are united as they first appear, in the first state of their action, the colour which we call green is the result.

The eye experiences a distinctly grateful impression from this colour. If the two elementary colours are mixed in perfect equality so that neither predominates, the eye and the mind repose on the result of this junction as upon a simple colour. The beholder has neither the wish nor the power to imagine a state beyond it. Hence for rooms to live in constantly, the green colour is most generally selected.

Though hardly a work of science, Theory of Colours stands as an absorbing account of the philosophy and artistic experience of color, bridging the intuitive and the visceral in a way that, more than two hundred years later, continues to intrigue.

Welcome. I'm Elaine Aron, author of and The Highly Sensitive Child, as well as The Highly Sensitive Person Workbook and The Highly Sensitive Person in Love, a book about how sensitivity affects our close relationships. I began researching high sensitivity in 1991 and continue to do research on it now, also calling it Sensory-Processing Sensitivity (SPS, the trait's scientific term). I never planned to write any self-help books, but those who have this trait seem to gain a great deal from knowing about it.

Are you highly sensitive? You can find out by taking the self-test. This test, the result of empirical research on the trait, gives you a good sense of what high sensitivity is, as well. To see if your child is highly sensitive there is another checklist.

If you find you are highly sensitive, or your child is, you need to begin by knowing the following:

  • Your trait is normal. It is found in 15 to 20% of the population--too many to be a disorder, but not enough to be well understood by the majority of those around you.
  • It is innate. In fact, biologists have found it to be in most or all animals, from fruit flies and fish to dogs, cats, horses, and primates. This trait reflects a certain type of survival strategy, being observant before acting. The brains of highly sensitive persons (HSPs) actually work a little differently than others'.
  • You are more aware than others of subtleties. This is mainly because your brain processes information and reflects on it more deeply. So even if you wear glasses, for example, you see more than others by noticing more.
  • You are also more easily overwhelmed. If you notice everything, you are naturally going to be overstimulated when things are too intense, complex, chaotic, or novel for a long time.
  • This trait is not a new discovery, but it has been misunderstood. Because HSPs prefer to look before entering new situations, they are often called "shy." But shyness is learned, not innate. In fact, 30% of HSPs are extraverts, although the trait is often mislabeled as introversion. It has also been called inhibitedness, fearfulness, or neuroticism. Some HSPs behave in these ways, but it is not innate to do so and not the basic trait.
  • Sensitivity is valued differently in different cultures. In cultures where it is not valued, HSPs tend to have low self-esteem. They are told "don't be so sensitive" so that they feel abnormal.

The Highly Sensitive Person's Workbook can be read and used alone, although its chapters parallel those in the first book. It further integrates your trait into your social, emotional, and work life. It helps you take better care of yourself and reframe your past. It also includes instructions for those who want to form a group of HSPs. The Workbook was previewed by HSPs to make it "user friendly," and they found it useful and thought-provoking.

In May 2000 The Highly Sensitive Person in Love was published, a blend of my lifelong research interest in close relationships and in HSPs. It's full of advice on how HSPs and non-HSPs can learn to live with their differences, as well as how a pair of HSPs can gain more from each other.

The Highly Sensitive Child was written in response to all those sensitive adults who say their childhoods were excruciatingly difficult, even when their parents had the best intentions, because no one knew how to raise them. Parents and teachers told them there were "too sensitive" or "too shy" or "too intense." HSCs have a tremendous amount to offer the world. But they do need special handling.

Comfort Zone began in 1996 as a newsletter strictly for HSPs. In the over 150 articles written since then, you will find topics as diverse as sensitive dogs and how to survive unemployment to Jungian psychology and the latest research on HSPs. From 1996 to 2004 it was printed and mailed out four times a year, for a fee. Back issues of these paper newsletters are available in the Store as long as they last. A lively presentation with many questions answered, from what to do about perfectionism and "is sensitivity the same as being psychic?" to "How can I be an HSP and love to drive fast?" Or "How can an HSP be an extravert?" Does not overlap with other books or audios.

The Highly Sensitive Person Unabridged Recorded Book by Elaine Aron and read with great verve by Shakespearean actress Barbara Caruso. A boxed set of 9 CDs (10 hours), each with tracks every 3 minutes for easy bookmarking. Great fun to listen to.

About Dr. Elaine Aron

Dr. Aron earned her M.A. from York University in Toronto in clincial psychology and her Ph.D. at Pacifica Graduate Institute in clinical depth psychology as well as interning at the C. G. Jung Institute in San Francisco. Besides beginning the study of the innate temperament trait of high sensitivity in 1991, she, along with her husband Dr. Arthur Aron, are two of the leading scientists studying the psychology of love and close relationships. They are also pioneers in studying both sensitivity and love using functional magnetic resonance imaging. She maintains a small psychotherapy practice in Mill Valley and San Francisco.
